This Privacy Policy (“Policy”) describes the information collected by or on behalf of Server Products, Inc. (“Server Products,” “we,” “us,” or “our”) through our publicly available websites and subdomains, including our main website at https://server-products.com/, including all of its subdomains (including our careers at portal: https://server-products.com/Careers) (the “Sites”); and our interactions with you both online and offline (collectively, “Services”), as well as how that information is used and disclosed. This Policy applies to all individuals: (i) who use or access our Services (including website visitors and job applicants); and (ii) who interact with us offline.

This Policy does not apply to websites, pages, mobile applications, or platforms operated by Server Products or its affiliates that do not contain a link to this Policy. For more information about how we handle Personal Information of employees, and independent contractors and other workforce members , please refer to our relevant policies and notices.  If you have questions or concerns about this Policy, please contact us as set forth in Section 10

We may modify or update this Policy from time to time. Material changes will be conspicuously posted on the Services or otherwise communicated to you in accordance with applicable law. Changes that in our sole discretion are material will be posted on the Services or otherwise communicated to you. All changes will be effective immediately upon posting to the Services, unless otherwise required by applicable law.

1. Information We Collect

We may collect information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you or your household (“Personal Information”) when you use our Services. The Personal Information we collect falls into three categories: (1) information you provide to us, (2) information we collect through automated methods, and (3) information we collect from other sources, each further detailed below. We will collect, use, and disclose such Personal Information pursuant to this Policy and applicable law.

Information We Collect from  Visitors to Our Services

The following describes Personal Information we collect from all visitors to our publicly available websites and subdomains, including our main Site, guest checkout portal, employee store, and used equipment marketplace.

We collect Personal Information that you provide directly to us. This may occur in the following ways:

Personalize Your Wish List: You can browse and select products on our Sites and build a personalized project and wish list on our Sites by submitting your project name, contact name, email address, and phone number. Please note that we do not have an online checkout function; however, you can take your wish list to purchase products from our authorized retailers, distributors, and other partners.

Job Applications: When you apply for a job with us, we will collect certain Personal Information contained in your application. If you wish to withdraw your application during the application process, you can contact us at any time at careers@Server-Products.com.

Contacting Us: When you contact us via email, phone, or the chat feature on our Site, we will collect and use your name and contact information and any additional Personal Information you choose to provide in your message, if applicable. Our Site includes a chat feature powered by livechat, through which you will be interacting directly with our customer care supervisors. If you choose to use this feature, any Personal Information you submit will be collected and used to respond to your inquiry and provide customer support.

Newsletter Sign Up: You can submit your first name, last name, email address, and company to sign up to get the latest on technology advancements, product howtos, and industry insights delivered directly to your inbox. To opt out from marketing emails, see Section 9.

Feedback: When you provide comments or feedback about our Site or Services, the content on the Services, or our products, including reviews and complaints (“Feedback”), we will collect Personal Information that you submit along with your Feedback. However, we will not treat Feedback as confidential, and we may use Feedback for any purpose in our sole discretion so long as it does not personally identify you. Feedback may be used without attribution or compensation to you.

Data Automatically Collected

We may use automated technologies to collect Personal Information from your computer system or mobile device when you use our Services. This may include the following:

We may use cookies, web beacons, pixel tags, social widgets, UTM codes and other tracking technologies (collectively “Tracking Technologies”) on our Services and in our email and other electronic communications with you, and most browsers automatically accept Tracking Technologies. The Services may include third-party Tracking Technologies, including those provided by Meta and Google Analytics, which collect and process information about your use of the Services. These technologies may collect information that can be used for profiling or tracking purposes. We will obtain your consent prior to deploying non-essential Tracking Technologies where required by applicable law.

You may be able to disable Tracking Technologies by changing your browser settings, depending on your browser, but disabling Tracking Technologies may impact your use and enjoyment of the Services. Not all features or functions of the Services may work properly if you disable Tracking Technologies. You cannot disable all Tracking Technologies, such as those that are essential to the functioning of the Services. For additional information, please review Section 2 (How We Use Your Information) under subheading “How We Use Data Collected by Tracking Technologies.”

Various browsers (i.e., Internet Explorer, Chrome, Firefox, Edge, etc.) allow a “Do Not Track” setting, which sends a signal to websites visited by an individual about their browser DNT setting. At this time, there is no general agreement on how companies, like us, should interpret DNT signals. Therefore, at this time our Services do not respond to “Do Not Track” signals transmitted by browsers.  

Data from Other Sources

We obtain Personal Information from other sources and we may combine that Personal Information with other data we may already have. For example, we will collect Personal Information from third parties when we offer or promote services in conjunction with another company and they provide contact information to us with appropriate consent from the individual as required by applicable law. We may also receive Personal Information from a service provider when you apply for a job with us.

2. How We Use Your Information  

We use Personal Information that we collect for the following purposes:

As Stated or Agreed to at the Point of Collection. We may use Personal Information for the purposes stated or agreed-to (or as is obvious) at the point of collection. For example, we may use your Personal Information to: (i) process and respond to your questions, comments, or complaints; and (ii) personalize your products wish list. We may also use your Personal Information as otherwise requested or consented to by you.

Administration.  We use Personal Information for administrative purposes, such as managing accounts and accounting records, complying with internal audit requirements, obtaining and maintaining insurance coverage, managing risks, obtaining professional advice, and understanding the Services’ demographics and user preferences.

Services Management. We use Personal Information for managing our Services, such as troubleshooting problems, improving the content and functionality of the Services, statistical and other analyses of the Services, and customizing the Services to you and our other users.

Business Analytics. We use Personal Information for business analytics purposes, including consumer and operations research, to assess the effectiveness of our Services (including online services, marketing, and advertising), to analyze market trends and customer demand, and to improve our offerings and business operations. 

Advertising and Other Communications. We may use Personal Information to send you advertisements, to notify you of new products, to notify you of new features on our Site or new services, to notify you of changes to our website terms or this Policy, and for other similar communications, subject to applicable laws and your consent where required. We may use third-parties or service providers to deliver communications to you. See your options for unsubscribing from marketing emails in Section 9.

Job Applications: We use Personal Information submitted in the application for purposes of filling the position for which you have applied. 

To Protect Our Rights.  We may use Personal Information to protect our legal rights or interests, or those of other parties, including to bring a legal action against you or anyone who may be causing harm to us, our Services, or to other users of the Services. We may also use Personal Information to seek business, financial or legal advice, and to respond to other legal requests.  

Create Aggregated and De-Identified Data. We may process Personal Information to create deidentified and aggregated data that is no longer reasonably capable of re-identification.  Any such deidentified and aggregated data is no longer subject to this Privacy Policy.  Server Products is the sole and exclusive owner of such de-identified and aggregated information.

How We Use Data Collected by Tracking Technologies. 

We use Tracking Technologies for the purposes described in this Policy, including to improve our Site, and in the following ways: 

  • Google Analytics. We use Google Analytics to collect and process information about your use of the Site. Google sets Tracking Technologies on your browser or device, and then your web browser will automatically send information to Google. Google uses this information to provide us with reports that we use to better understand and measure how users interact with our Site. To learn more about how Google uses data, visit Google’s Privacy Policy and Google’s page on “How Google uses data when you use our partners’ sites or apps.” You may download the Google Analytics Opt-out Browser Add-on for each web browser you use, but this does not prevent the use of other analytics tools. To learn more about Google Analytics cookies, visit Google’s “Google Analytics Cookie Usage on Websites” page.
  • Third-Party Content: The Services includes content provided by third parties, such as YouTube® videos. Those third parties may use Tracking Technologies that collect information about your use of such content and our Site.

3. Retention of Personal Information

We will keep Personal Information for the period necessary to fulfill the purposes described in this Policy, or as otherwise required or permitted by applicable law. We take reasonable steps to delete the Personal Information we collect when: (1) we have a legal obligation to do so, (2) we no longer have a purpose for retaining the information, or (3) if you ask us to delete your Personal Information, unless we determine that doing so would violate our existing legal, regulatory, dispute resolution, contractual, or similar obligations. We may also decide to delete your Personal Information if we believe it is incomplete, inaccurate, or that our continued storage of your Personal Information is contrary to our legal obligations or business objectives. When we delete your Personal Information, it will be removed from our active servers and databases; however, it may remain in our archives when it is not practical or possible to delete it.

4. Disclosure of Personal Information

We may disclose Personal Information to the following categories of third parties, in compliance with applicable laws:

Affiliates. We may disclose Personal Information to our corporate subsidiaries and affiliates and with their respective officers, directors, employees, and agents in order to provide and improve our products and Services. Our affiliates process Personal Information only on our behalf and at our direction, subject to contractual obligations requiring them to protect Personal Information as described under this Policy. Our affiliates do not use Personal Information disclosed by Server Products for their own independent purposes.

Third Parties and/or Service Providers.  We may disclose Personal Information to third parties and/or service providers that provide services for us. For example, we may disclose Personal Information to vendors, contractors and business partners to help us host and manage the Services, provide advertising and marketing, improve the content and functionality of the Services, provide payment processing, perform credit checks, provide order fulfillment and shipment, perform data and statistical analyses, troubleshoot problems with the Services, and support or provide the security of the Services.  We take commercially reasonable steps to ensure our third-party vendors, contractors, or business partners provide at least the same level of protection for Personal Information as we do. In some cases, a third-party provider may interact with you directly in connection with our Site or our products and services. To the extent we do not receive, access, or store Personal Information that you provide to such third-party provider(s), such data collection is subject to that third-party provider’s privacy policies and/or applicable terms of use, which are made available to you to the extent required by appliable laws.

Government Officials / Law Enforcement. We will cooperate with law enforcement and other governmental agencies, and may disclose Personal Information: (i) if we believe in good faith we are legally required to disclose that Personal Information, (ii) if we are advised to disclose Personal Information by our legal counsel, (iii) to the extent permitted by applicable law, when necessary to identify, contact or bring a legal action against someone who may cause or be causing harm to, or interfering with the legal rights of, Server Products or any other party, or (iv) as otherwise required or permitted by applicable law.

Professional Advisors.  We may disclose Personal Information to our professional advisors, such as our attorneys, accountants, financial advisors and business advisors, in their capacity as advisors to Server Products. 

Subsequent Owner or Operator. We may disclose your Personal Information to a successor entity or an operator upon a merger, consolidation, acquisition, bankruptcy, dissolution, liquidation or other corporate reorganization or discussions related to the same, to a purchaser or potential purchaser of all or a portion of our assets, or pursuant to a financing arrangement or co-promotional agreement, subject to applicable laws. The Personal Information we have about you may be transferred to parties to the transaction.

Other.  We may disclose Personal Information to third parties when explicitly requested by or consented to by you, or for the purposes for which you disclosed the Personal Information to us as indicated at the time and point of the disclosure (or as was obvious at the time and point of disclosure).

5. Children’s Information

The Services is not directed at children under 18 years of age. We do not knowingly collect, sell, use, or share Personal Information from children under 18. If we obtain actual knowledge that any Personal Information has been provided by a child under the age of 18, we will promptly delete that information. If a parent or legal guardian learns that their child provided us with Personal Information without his or her consent, please contact us and we will make commercially reasonable attempts to delete such Personal Information.

6. Data Security

We use commercially reasonable technical and organizational measures to help secure Personal Information against loss, misuse, and alteration appropriate to the type of Personal Information processed. However, no data transmission over the internet can be guaranteed to be 100% secure, and it is not possible to guarantee security. Any transmission of information is at your own risk.

7. Access from Outside the United States

Our Services are hosted from the United States. If you access the Services from outside the United States, please be aware that your Personal Information may be transferred to, stored, and processed in the United States, where our servers are located and our databases are operated. When transferred outside of your jurisdiction of residence, your Personal Information may be subject to lawful requests by foreign law enforcement and other authorities, and may be subject to local laws that differ from those in your jurisdiction.

8. Third-Party Websites

The Site may link to, or be linked from, websites not controlled by us. We are not responsible for third parties’ privacy policies or practices. This Policy does not apply to any third-party websites or to any data that you provide to third parties. You should read the privacy policy for each website that you visit.

Our Sites may contain links or icons to third-party social media platforms, including Meta®, Instagram®, and LinkedIn® (“Social Media”). If you choose to interact with us or post content on Social Media, anything you post will be considered public information and will not be treated confidentially. We may post (or re-post) on the Services and our Social Media pages any comments or content that you post on our Social Media pages. Your use of Social Media is governed by the privacy policies and terms of the providers that own and operate those platforms and not by this Policy. We encourage you to review those policies and terms.

9. Your Choices to Control Your Information

Tracking Technologies: To disable certain Tracking Technologies, including advertising and analytics cookies, please see Section 2 How We Use Your Information. You also may use the cookie preferences feature on our Site. 

Email Communications: To provide you with information regarding Server Products or our other products or offerings, we may send you promotional materials or other information via email (“Email Communications”). You may choose to stop receiving Email Communications by clicking on the “Unsubscribe” link located at the bottom of a marketing email that we send to you. Please note that certain Email Communications that are transactional in nature (for example, emails about your order, or a change in terms and features of your account) may not contain an unsubscribe link or opt-out instructions.

NOTICE TO CALIFORNIA CONSUMERS

This Section provides additional terms that apply to California Consumers. In the event of a conflict between this Section and the remainder of this Policy, this Section shall take precedence for California Consumers.  In this Section only, any capitalized terms not defined in this Policy have the meanings set forth in the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020, and including its implementing regulations (the “CCPA”). If you are a California resident, these CCPA rights apply regardless of whether you interact with us in a personal, job applicant, or business-to-business context.

The Collection, Source, Purpose and Sharing of Your Personal Information.

Categories of Personal Information.  In the last twelve (12) months, we have collected the following categories of Personal Information: 

  • Identifiers: consisting of real name, postal address, internet protocol address, email address, and other similar identifiers.
  • Commercial information: consisting of products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.
  • Personal Information described in subdivision (e) of Section 1798.80: including name, address, and phone number.
  • Internet Activities consisting of: browsing history, search history, and information regarding a Consumer’s interaction with an internet website, or advertisement.
  • Professional or employment-related information consisting of: information contained in your application and resume including past jobs and education.

Categories of Sources from Which Personal Information is Collected.  The categories of sources from which your Personal Information is collected are described in Section 1 (Information We Collect)

Purposes for Collecting Personal Information. We use the categories of Personal Information listed above for our business purposes and commercial purposes of providing cross‑context behavioral advertising, as disclosed in Section 2 (How We Use Your Information) and for the following business purposes expressly identified by the CCPA, which fall under one or more of the following categories below:

  • Auditing related to counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance with this specification and other standards.
  • Helping to ensure security and integrity to the extent the use of your Personal Information is reasonably necessary and proportionate for these purposes.
  • Debugging to identify and repair errors that impair existing intended functionality.
  • Short-term, transient use, including, but not limited to, non-personalized advertising shown as part of your current interaction with us.
  • Performing services on our behalf, including maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, processing payments, providing storage, or providing similar services on our behalf.
  • Providing advertising and marketing services to you, except for cross-context behavioral advertising.
  • Undertaking internal research for technological development and demonstration.
  • Undertaking activities to verify or maintain the quality or safety of a service or device that is owned, manufactured, manufactured for, or controlled by us, and to improve, upgrade, or enhance the service or device that is owned, manufactured, manufactured for, or controlled by us.
  • Other purposes as expressly authorized by the implementing regulations of the CCPA.

Categories of Our Service Providers or Contractors with Whom Personal Information is Disclosed for a Business Purpose.  In the last 12 months we have disclosed all the categories of Personal Information listed above for our business purposes. The categories of Service Providers or Contractors with whom we disclose Personal Information in the last 12 months are described above in Section 4 (Disclosure of Personal Information)

Categories of Third Parties with Whom Personal Information is Sold or Shared.

In the last twelve (12) months, we have “sold” or “shared” the following categories of Personal Information for cross-context behavioral advertising purposes: Identifiers (including internet protocol addresses and device/browser identifiers) and Internet Activities. These categories of Personal Information have been sold or shared to analytics and advertising technology providers.

Your California Privacy Rights

California Consumers have the right to make the following requests:

  • Right to Know and Access.  You have the right to request that we disclose the following information to you regarding our collection and use of your Personal Information:
    • The categories of Personal Information we have collected about you;
    • The categories of sources from which we collect the Personal Information about you;
    • The business or commercial purpose(s) for which the Personal Information was collected, sold, or shared;
    • The categories of third parties with whom we disclose that Personal Information;
    • The specific pieces of Personal Information we collected about you; and
    • The categories of Personal Information that we sold or shared, and the categories of third-party recipients to whom it was sold or shared.
  • Right to Delete.  You have the right to request that we delete any of your Personal Information that we collected from you and retained.
  • Right to Opt-out of “Sale” and Certain “Sharing” Practices. You have the right to opt-out of the “sale” and “sharing” of your Personal Information with third parties, as those terms are defined under CCPA. Our Sites support the Global Privacy Control (“GPC”) opt-out preference signal. If you have enabled GPC in your browser, we will treat that signal as a valid request to opt out of the sale and sharing of your Personal Information.
  • Right to Correct. You have the right to request that we correct inaccurate Personal Information that we maintain about you, taking into account the nature of the Personal Information and the purposes of the processing.
  • Right to Non-Discrimination. We will not discriminate against or retaliate against you for exercising any of your rights under the CCPA. However, we may offer a different price, rate, level, or quality of goods or services if the difference is reasonably related to the value provided by your data.
  • Right to Limit Use and Disclosure of Sensitive Personal Information.  In certain circumstances, you have the right to limit the use and disclosure of Sensitive Personal Information.

How to Exercise Your California Privacy Rights.  To exercise your California privacy rights, you may submit your request to us by contacting us:

Form: Submit our Consumer Privacy Request Form available on our website without logging in. If you already have an account, you may also submit a request through your account, but creating an account is not required. 

Verifiable Consumer Request.  In order to verify your request, we may require additional information to allow us to reasonably verify you are the person about whom we collected Personal Information, and you must describe your request with sufficient detail to allow us to properly understand, evaluate, and respond to your request. This information may vary depending on the Personal Information we already have. If we are unable to verify your identity as required by applicable laws and regulations, we will decline to comply with your request, and let you know why. We may reject or deny your request as permitted or as required by law. We may charge a fee as permitted by the CCPA, such as to process or respond to your request if it is excessive, repetitive, manifestly unfounded, or if we believe the request is fraudulent or submitted for purposes other than exercising applicable privacy rights.

Authorized Agents. You may only make a request to exercise your rights on behalf of yourself, or a parent or legal guardian may make a request on behalf of their minor child. You also have a right to submit requests to exercise your rights under the CCPA through an authorized agent. If an authorized agent submits a request on your behalf, we may require the agent to provide proof that you gave the agent signed permission to submit the request.  We may also require you to either (1) verify your own identity directly with us, or (2) directly confirm with us that you provided the authorized agent permission to submit the request.  However, we will not require you to resubmit your request in your individual capacity when you use an authorized agent.  We will not require a power of attorney in order for you to use an authorized agent to act on your behalf.  If your authorized agent holds a power of attorney pursuant to California Probate Code sections 4121 to 4130, the foregoing verification requirements do not apply.

If We Deny Your Request. We will acknowledge your request to delete, correct, or know within 10 business days and respond within 45 calendar days of receipt. If reasonably necessary, we may extend this period by an additional 45 calendar days (for a maximum of 90 days total), in which case we will notify you of the extension and the reason for the delay within the initial 45-day period. If we deny your request in whole or in part, we will provide a detailed explanation of the basis for the denial and, where applicable, provide any personal information that is not subject to an exception. For requests to opt out of the sale or sharing of your personal information, we will comply within 15 business days.

NOTICE TO NEBRASKA AND TEXAS CONSUMERS

This Section provides additional terms that apply to Nebraska and Texas Consumers. In the event of a conflict between this Section and the remainder of this Policy, this Section shall take precedence for Nebraska and Texas Consumers.  In this Section only, any capitalized terms not defined in this Policy have the meanings set forth in the Nebraska Data Privacy Act (the “NDPA”) and the Texas Data Privacy and Security Act (the “TDPSA”). If you are a resident of Nebraska and Texas, these rights apply when you interact with our Services in an individual or household capacity (i.e., not in a business or employment context), such as when you browse our public website, sign up for newsletters, we use cookies or similar identifiers for advertising, or you rent our equipment for household use. These rights do not apply to your information when you interact with us solely in a business-to-business or employment context, except where noted.

Your Privacy Rights Under NDPA and TDPSA

Although these rights may vary slightly between states, Nebraska and Texas Consumers have the right to make the following requests with regard to their Personal Data. Controllers are required to respond to consumer requests free of charge (up to twice annually per consumer under the NDPA, and at least twice annually per consumer under the TDPSA). If a request is manifestly unfounded, excessive, or repetitive, the controller may charge a reasonable fee to cover administrative costs or may decline to act on the request.

  • Right to Know. You have the right to request confirmation whether or not we are processing your Personal Data and to access such Personal Data.
  • Right to Data Portability. Where your Personal Data is available in a digital format, you have the right to request a copy of Personal Data that you previously provided to us. For Nebraska Consumers, this right applies only where the processing is also completed by automated means, in which case the data will be provided in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another controller without hindrance.  For Texas Consumers, the data will be provided in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another controller without hindrance.
  • Request to Delete. You have the right to request deletion of certain of your Personal Data that we have collected.
  • Right to Correction. You have the right to request that we correct inaccuracies in your Personal Data.
  • Right to Opt Out. You have the right to opt out of the processing of Personal Data for purposes of: (a) targeted advertising, (b) the sale of Personal Data, or (c) profiling in furtherance of a decision that produces a legal or similarly significant effect concerning the consumer. 
  • Right to Non-Discrimination. You have the right not to be discriminated against for exercising your privacy rights outlined above.

How to Exercise Your State Privacy Rights.  To exercise the privacy rights described in this Section, you may submit your request to us by contacting us at marketingcms@Server-Products.com. 
Authentication of Your Request. We will require sufficient information to verify your identity and the authenticity of your request. If you do not provide us with sufficient information, we may request additional information to verify your request. Certain types of requests may require additional verification, as we may be subject to higher standards of authentication for such requests. We may reject or deny your request as permitted or as required by law.

Authorized Agent. The NDPA and TDPSA permit the designation of an authorized agent to opt out of the processing of Personal Data for purposes of targeted advertising and the sale of Personal Data on your behalf. If we receive a request from an authorized agent, we will need to verify your identity as the data subject and the agent’s authority to act on your behalf. We may deny a request from an authorized agent if we do not have proof that they are authorized by you to act on your behalf.

Appeal. If we reject or deny your request, you may appeal our decision within a reasonable amount of time after receiving our denial by responding directly to the communication denying your request or by submitting your appeal to marketingcms@Server-Products.com. Upon receipt of your appeal, we shall respond in writing of any action taken or not taken within 60 days after receipt. If we deny your appeal, we will provide you with an online mechanism through which you may contact the Texas Attorney General to submit a complaint.

NOTICE TO CANADIAN RESIDENTS

This Section provides additional terms that apply to Canadian residents. In the event of a conflict between this Section and the remainder of this Policy, this Section shall take precedence for Canadian residents.

Consent

Except where the law provides for an exception to consent, we will only process your Personal Information with your consent, which may be express or implied as permitted by applicable law.

Your Rights

Under certain circumstances and subject to applicable laws, supported by a written request and proof of identification, you may access Personal Information about you that we have collected, used or disclosed, and/or ask that it be corrected, and/or withdraw your consent to our disclosure or use of your Personal Information.
